Terms of Service

1. Acceptance of Terms

By accessing or using OpenClawBazaar ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. We may update these terms from time to time — continued use after changes constitutes acceptance of the revised terms.

2. The Platform

OpenClawBazaar is a marketplace that connects buyers with independent creators selling OpenClaw AI agent personas, skills, configurations, and related digital goods. We provide the infrastructure and tools; creators are solely responsible for the content they publish.

3. Purchases & Licensing

• All digital goods are sold as final sales and are non-refundable except where required by applicable law.
• Purchases grant a personal-use license only. Redistribution, resale, or sublicensing is prohibited unless explicitly stated in the listing.
• Creators set their own pricing. OpenClawBazaar collects payment on behalf of the creator and remits the creator's share minus the platform commission.

4. Accounts

• You are responsible for maintaining the security and accuracy of your account credentials.
• Accounts that violate these terms or our policies may be suspended or terminated without prior notice.
• Creating multiple accounts to circumvent restrictions or manipulate the platform is prohibited.

5. Creator Responsibilities

Creators who list digital goods on OpenClawBazaar represent and warrant that they have the right to sell such content, that the content does not infringe on any third-party intellectual property rights, and that descriptions are accurate and not misleading.

6. Third-Party Content

OpenClawBazaar does not review, endorse, verify, or guarantee any listing or content published by creators. We disclaim responsibility for the accuracy, quality, legality, or suitability of any digital goods sold through the Platform. Disputes between buyers and creators should first be addressed through our support process.

7. Prohibited Conduct

• Uploading malicious code, harmful payloads, or content designed to damage systems.
• Impersonation of other creators or users.
• Listing stolen, plagiarized, or unauthorized content.
• Attempting to circumvent platform security or payment systems.
• Engaging in review or rating manipulation.
• Any activity that violates applicable law.

8. Warranty Disclaimer

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, OpenClawBazaar's total liability shall not exceed the greater of (a) the total amount you paid to the Platform in the twelve months preceding the claim, or (b) $100 USD. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold harmless OpenClawBazaar, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform, violation of these terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice. Sections 6, 8, 9, and 10 survive termination.

12. Governing Law

These terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved in the courts located in Laramie County, Wyoming.
